This is a working draft, not reviewed by a lawyer. It exists so this product has a real, specific policy to point people at instead of nothing, but treat it as a starting point — get it reviewed against the actual laws that apply to your customers (electronic-monitoring notice statutes, GDPR, and similar) before relying on it for real customers.
Agreement
These terms govern use of Timecard by an organization ("the Organization") and the people it adds as users. By creating an Organization account, or by logging in to an account someone else created for you, you agree to these terms and to the Privacy Policy.
Who is responsible for what
The Organization's admin(s) are responsible for lawfully deploying Timecard to their team — including giving employees whatever advance notice is legally required in their jurisdiction before monitoring software is installed on their device, and for having a lawful basis to process their employees' data. Timecard provides the visible tracking indicator, the acknowledgment step, and the access log as tools to help with that; it does not substitute for the Organization's own legal compliance.
Acceptable use
Don't use Timecard to monitor anyone who isn't your own employee/contractor under a lawful employment or engagement relationship. Don't attempt to disable, hide, or misrepresent the tracking indicator to the person being monitored. Don't use the API, webhooks, or any other integration to extract data you wouldn't otherwise be entitled to see under your role.
Service availability
Timecard is provided on a best-effort basis. As a pre-revenue product, we do not currently offer an uptime service-level agreement, and infrastructure may include free/shared-tier hosting with occasional cold-start delays. We'll fix things when we know about them, but we're not promising 24/7 monitoring of our own systems yet.
Data and deletion
See the Privacy Policy for what's collected, how long it's kept, and how automatic retention purging works. Deleting an Organization's account will delete its data; ask us before that's irreversible if you're not sure.
No warranty, limited liability
Timecard is provided "as is," without warranty of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the product, including decisions made based on the time-tracking or activity data it produces.
Changes
We may update these terms as the product changes. Material changes will be reflected by updating the date at the top of this page.
